My Way News - Music Industry Group Fires Back at Apple: "A recording industry group fired back Wednesday at Apple Inc. (AAPL) CEO Steve Jobs, suggesting his company should open up its anti-piracy technology to its rivals instead of urging major record labels to strip copying restrictions from music sold online.
Mitch Bainwol, chairman and chief executive of the Recording Industry Association of America, said the move would eliminate technology hurdles that now prevent fans from playing songs bought at Apple's iTunes Music Store on devices other than the company's iPod.
'We have no doubt that a technology company as sophisticated and smart as Apple could work with the music community to make that happen,' Bainwol said in a prepared statement.
In an essay posted Tuesday on the Cupertino-based company's Web site, Jobs called on record labels to abandon their requirement for online music to be wrapped in Digital Rights Management, or DRM, technology, which is designed to limit unauthorized copying.
The major record labels - Universal Music Group, EMI Music, Sony BMG Music Entertainment and Warner Music Group - control some 70 percent of the music market and have maintained that DRM safeguards are needed to stave off rampant piracy.
Jobs said eliminating such restrictions would open up the online music marketplace.
Songs purchased on iTunes are wrapped in Apple's proprietary version of DRM technology, known as 'FairPlay.' Songs purchased from rival online stores that carry different DRM technology cannot be played on iPods.
In his essay, Jobs said Apple is against licensing 'FairPlay' as an alternative method for making iTunes accessible to all portable players, because making the technology widely available would make it easer for hackers to figure out how to bypass it."

(AAPL) to open its iTunes music store to players other than its iPod, but said Wednesday the company was skirting key issues and passing responsibility to record companies.
Norway is leading a European campaign to force Apple to make its iTunes online store compatible with rivals' digital music players. This month, Norway's consumer regulator declared the lack of interoperability illegal, and gave Apple until Oct. 1 to change it or face legal action and possible fines.
In an open letter on Apple's Web site Tuesday, Chief Executive Steve Jobs said he was ready to open iTunes to players other than iPods if the world's major record labels abandoned their anti-piracy technology.
In the letter called 'Thoughts on Music,' Jobs argued for abolishing the protections known as 'Digital Rights Management,' or DRM, saying that technology was the main reason music sold through iTunes can't be transferred to other portable players.
'We welcome Apple taking this problem seriously, and addressing it at such a high level,' Torgeir Waterhouse, senior adviser to the Consumer Council, told The Associated Press. However, he said Apple was hiding behind the record companies and distorting aspects of the dispute in the letter.
Jobs said consumers unhappy with the current system should push the world's four largest labels - Vivendi SA's Universal Music Group, EMI Group PLC, Sony BMG Music Entertainment and Warner Music Group Corp. (WMG) - to sell their online catalogs without the DRM restrictions."

He also explained why Apple had decided against licensing its own DRM technology, known as 'FairPlay,' as an alternative method for making iTunes accessible to all portable players.
Like many things the trendsetting Jobs does, his call for change created an almost immediate buzz.
Supporters hailed Jobs for leveraging Apple's growing clout as one of the world's largest music sellers in an attempt to remove restrictions that annoy many consumers. Critics, though, derided the message as a disingenuous maneuver designed to soften a recent backlash in Europe, where iTunes' incompatibility with other portable music devices besides the iPod has been branded has anticompetitive.

Jobs' essay, dubbed 'Thoughts on Music,' cited the recording labels' anti-piracy technology as the main reason music sold through iTunes can't be transferred to other portable players besides the iPod.

Sony revealed as buyer of Ipix patents CNET News.com: "Sony has bought $3.6 million in intellectual property from imaging technology company Ipix, a court has revealed.
The auction for the Ipix intellectual property assets, which includes patents held domestically and abroad, took place in open court as part of the company's bankruptcy sale, according to a court order granting Ipix permission to sell its intellectual property and assets.
Ipix, which traded on the Nasdaq, filed for Chapter 7 bankruptcy on July 31, 2006, with the U.S. Bankruptcy Court for the Eastern District of Virginia.
Sony was initially represented by a law firm as an anonymous bidder and won with the highest offer: $3.6 million for all of Ipix's patents held both domestically and internationally, as well as any outstanding patent applications or provisional patent applications on new inventions. It was revealed on Friday, at a court hearing approving the sale, that Sony was the bidder.
The sale included more than 35 U.S. patents and patent applications on technology involving immersive still photography, 360-degree digital immersive video and a camera with gigapixel resolution, as well as more than 50 patents and patent applications on the same or similar technology filed in Australia, Austria, Canada, Germany, the European Union and Japan."

Wii outselling PS3 in Japan CNET News.com: "Nintendo's Wii game console outsold Sony's PlayStation 3 by nearly three to one last month in Japan, the country's largest video-game magazine publisher said Tuesday.
Nintendo sold 405,000 Wii units in January, compared with 148,000 PS3s, publisher Enterbrain said.
Wii and PS3, made by two of the biggest players in the $30 billion global video game industry, went on sale late last year in a three-way showdown with Microsoft's Xbox 360.
A wider range of software titles and a lower price tag is helping the Wii, Enterbrain said.
The basic model of the PS3 sells for $416 (49,980 yen) in Japan, double the price of the Wii.
Nintendo has sold a total 1.4 million units of the Wii in Japan, far outpacing the 614,000 PS3s sold, Enterbrain said.
'There could be a price cut for the PS3 by the end of the year, and more software titles will hit the market. I expect the PS3 to be doing better after awhile,' Enterbrain President Hirokazu Hamamura said. 'Of course, the Wii will keep running ahead all the while.' "

My Way News - Apple: iTunes Users Should Wait on Vista: " Apple Inc. (AAPL) is urging some iPod and iTunes users to hold off on upgrading computers to Windows Vista, warning that the iTunes music software may not work well with the new operating system from rival Microsoft Corp. (MSFT)
Apple said iTunes may work with many Vista computers, but the company knows of some compatibility problems and recommends that users wait until it resolves the issues with an iTunes update in the next few weeks, the company said in a statement provided Friday by spokesman Derick Mains. The iTunes software is key to synching music on computers with iPod portable players.
Microsoft launched Vista, its first major overhaul of Windows in five years, on Tuesday.
Though Microsoft and Apple are partners in some cases - iTunes works with Windows PCs and Microsoft Office has a version for Macs - the two are also entrenched rivals. With Vista's launch, Apple ramped up its ad campaign attacks against Windows.
According to a notice posted on Apple's Web site, compatibility problems include the inability to play music or video purchased from the online iTunes store, difficulties synchronizing contacts and calendars and possible failures of iPods plugged into a Vista computer. Apple also outlined precautionary steps users could take to try to minimize any problems should they upgrade to Vista now.
Adam Anderson, a spokesman for Microsoft's Windows division, said the company did not believe iTunes users 'should stop using Vista for these reasons.'"

DailyTech - Apple, Cisco Extend Negotiations on iPhone Trademark: "The battle commanders over the iPhone trademark on Thursday agreed to a temporary truce in hopes to reach an agreement before taking things to the courts.
In a joint statement from Apple and Cisco regarding iPhone trademark, the companies have announced that they “have agreed to extend the time for Apple to respond to the lawsuit to allow for discussions with the aim of reaching agreement on trademark rights and interoperability.”
While the iPhone name may already be associated with Apple and the rest of its iLife products, Cisco has owned the iPhone trademark since 2000. In fact, Cisco in December 2006 launched its own line of telephony devices carrying the iPhone brand. Apple then bravely announced its wireless product carrying the same name in January.
Cisco took immediate exception to Apple’s use of its trademark and sued for infringement. “Cisco entered into negotiations with Apple in good faith after Apple repeatedly asked permission to use Cisco's iPhone name,” said Mark Chandler, senior vice president and general counsel for Cisco. “There is no doubt that Apple's new phone is very exciting, but they should not be using our trademark without our permission.”

Is the iPod Killer…Dying? - Tech News - Playfuls.com - Science & Technology: "Bryan Lee, the head of the Zune project for Entertainment and Devices Division at Microsoft, is leaving the company “to focus on the next chapter in his life,' but analysts claim it’s something fishy about his departure.

A spokeswoman for the Redmond behemoth declared that the corporate vice-president at the EDD is stepping down 'to pursue personal interests.” Zune is Microsoft's digital portable media player and is also associated with the online music store (an iTunes rival). The portable MP3 player was released to the U.S. market with a 30 GB model for US$249.99 on November 14, 2006.

The EDD planned a $100 million advertising campaign for Zune, with 'music the way it wants to be' as a major theme. Microsoft has enrolled approximately 300 'Zune masters' to advertise the device on American college campuses. They receive free merchandise, including a Zune; in return, they are expected to promote the item and run Zune-related events.

But apparently this was not enough. The Zune (previously called “the famous iPod-killer”) didn’t scratch the surface of the iPod.

Overall, Apple still maintains a tight grip on the MP3 players market, with 82.7 percent market share for the hard-drive iPods in the first half of December 2006, but down from the 86.8 percent registered last year. Considering both hard-drive and flash-based MP3 players, Apple holds an impressive 62.2 percent market share for its gadget, almost the same percent as in 2005 (63%)."

Sony Profits Drop 5 Pct on PS3 Cost: "Sony's quarterly profit dipped 5 percent as huge costs for launching its PlayStation 3 video game console offset a recovery in its electronics business.
But in an optimistic sign, the Japanese manufacturer raised its full-year earnings forecast Tuesday, saying that booming Christmas sales in digital cameras and flat-panel TVs outpaced earlier targets.
Group net profit at Sony Corp. (SNE) for the three months through December slipped to 159.9 billion yen ($1.3 billion) from 168.9 billion yen the same period a year earlier.
The electronics and entertainment company behind the Walkman portable player and 'Spider-Man' movies said quarterly sales jumped 9.8 percent to 2.61 trillion yen ($21.4 billion).
Sony embarked on a turnaround effort under its first foreigner chief executive, Welsh-born American Howard Stringer, who took the helm in 2005. It has dropped unprofitable businesses, sold off assets, reduced jobs and closed plants.
For the last several years, Sony's biggest problem was long in its core electronics business, where it fell behind Apple Inc. (AAPL) and its iPod portable music player and Samsung Electronics Co.'s flat-panel TV business.
Sony was dealt another blow last year when it announced a massive global recall of about 10 million lithium-ion batteries used in not only its own laptops but also Apple, Dell Inc. (DELL), Lenovo and others."
